Terms of Use for EcoSort

1. Introduction

These Terms of Use govern your use of EcoSort (“the App”), operated by Arsenii Koriagin, a sole proprietor (autónomo) registered in Spain (the “Company”, “we”, “our”). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, you must stop using the Service.

2. Definitions

  • Service — the App and all related features, content, and functionality provided by the Company.
  • Account — a user account required to access certain features.
  • EcoSort Pro — a paid subscription unlocking enhanced features, including increased scanning limits.
  • Unlimited Scans — a feature allowing high-volume scanning under a Fair Use Policy.
  • Fair Use Policy — usage rules described in Section 7.2.

3. Eligibility

You must be at least 16 years old (or the minimum digital consent age in your region) to use the Service.

4. License & Acceptable Use

The Company grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You agree not to:

  • interfere with, damage, or disrupt the Service;
  • use automated tools or bots to access the App;
  • perform large-scale automated scanning or scraping;
  • reverse engineer, modify, or decompile the App;
  • use the Service in violation of local laws or waste regulations;
  • share your Account with other individuals or organizations.

5. User Accounts

You are responsible for maintaining the accuracy of your Account information and the confidentiality of your credentials. You are responsible for all activities occurring under your Account.

6. Subscription, Payments & Billing

Certain features, including EcoSort Pro, require payment. All purchases are processed through Apple App Store or Google Play and are subject to their respective policies.

6.1 Automatic Renewal

EcoSort Pro subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period.

  • Your account will be charged for renewal within 24 hours before the current period ends.
  • You can manage or cancel your subscription in your App Store or Google Play settings.
  • Deleting the App does not cancel your subscription.

6.2 Refunds

All payments are final, except where required by applicable law. Refunds, if applicable, are handled exclusively by Apple or Google according to their policies.

7. Fair Use Policy & Unlimited Scans

7.1 Purpose of Fair Use

“Unlimited Scans” is intended for normal individual usage, not for industrial, commercial, or automated use.

7.2 Fair Use Threshold

As a guideline, reasonable usage is considered to be up to approximately 5,000 scans per rolling 30-day period. This threshold helps maintain service quality and prevent abuse.

The Company reserves the right to:

  • throttle or rate-limit your scanning speed,
  • restrict access to scanning features,
  • suspend or terminate accounts that violate this policy.

Examples of prohibited usage include:

  • automated bulk scanning or machine-scale scanning,
  • using EcoSort as part of a commercial workflow,
  • sharing a Pro account across multiple users or organizations.

8. Eco Advice Disclaimer (Important)

The App provides sorting suggestions, recycling recommendations, and ecological information using automated algorithms. These recommendations may not always be accurate or applicable to your local waste management rules.

Local regulations vary by municipality, region, and country. You are solely responsible for ensuring proper waste disposal in accordance with local laws.

The Company is not responsible for any fines, penalties, sanctions, or damages resulting from incorrect sorting, disposal actions, or reliance on the App’s suggestions.

9. Disclaimers

The Service is provided “as is” and “as available.” The Company disclaims all warranties, express or implied, including but not limited to:

  • merchantability,
  • fitness for a particular purpose,
  • non-infringement,
  • accuracy or completeness of results,
  • uninterrupted or error-free service.

10. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, special, consequential, or punitive damages.

If liability cannot be fully excluded, our total liability will not exceed the amount you paid to the Company in the preceding 12 months.

11. Intellectual Property

All content, software, designs, trademarks, and algorithms in the App belong to the Company or its licensors. You may not copy, distribute, or create derivative works from the App without written permission.

12. Termination

The Company may suspend or terminate your access at any time for violating these Terms or engaging in abusive behavior.

You may stop using the Service at any time. Subscription payments remain non-refundable except where required by law.

13. Modifications to the Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the most recent version. Continued use of the Service indicates acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Spain and the autonomous community of Catalonia. Disputes shall be resolved in the courts of Barcelona, Spain, unless mandatory law requires otherwise.
